What is mediation?
Mediation is an effective method of dispute resolution. It can
save costs, time and business relationships.
It is an intensive process but its emphasis on the needs of the
parties and the desire to find a solution, rather than on legal
processes, means that it has a very high success rate, with over 80% of
mediations being settled.
The benefits of mediation
When questioned, participants in mediation frequently confirm that
they have found the process more satisfactory and less stressful than
actions through the courts and highlight in particular the benefit of
finding their own solution rather than having one imposed on them.
Mediation is a cost and time effective method of resolving
disputes. It usually works out considerably cheaper than the
alternative of taking action through the courts.
Typically, a mediation will take place through the course of one
day, or even half a day on smaller matters.
The role of the mediator
A qualified mediator has the skills and experience to assess
widely varying situations and to help both parties to reach a mutually
workable solution. The mediator does not solve the problem or impose a
solution on the parties but stands impartially between the parties and
assists them to find their own solution.
Is mediation right for you?
If you are in dispute, or even predict that you may find yourself
in dispute, with a business partner, family member, neighbour, supplier
or customer, it is worth considering mediation as a way of seeking a
swift resolution to the problem.
