INTRODUCTION
Land at Kelshall, Royston, Hertfordshire extends to approximately 16.69 Hectares (41.24 Acres) is offered as follows:

OPTION 1- MOWING LICENCE - 1st July 2025 until 19th September 2025

OPTION 2- 5 YEAR FARM BUISNESS TENANCY BY INFORMAL TENDER - TENANCY START DATE: 29th SEPTEMBER 2025

THE LAND
The land comprises 41.24 acres (16.69 Ha) of arable land, split into two field enclosures and currently cropped with a Timothy grass ley (4th year as a ley).

The land is classified as Grade 2 agricultural land, capable of growing a wide variety of arable crops and grass. The soil is of the Hanslope series, being lime-rich loamy and clayey soils. The boundaries comprise mature hedgerows, with a broadleaf tree belt dividing the two parcels and a post and netting fence along the northern boundary.

The land is situated between the Hertfordshire villages of Kelshall and Sandon, approximately 5 miles southwest of Royston and 6 miles east of Baldock, with frontage onto the public highway.

Access
The Land benefits from two points of access onto the public highway, via two field gateways.

Basic Payment Scheme & De Linked Payments
There are no de linked payments included.

Countryside Stewardship/ Environmental Land Management Schemes
The Landlord will permit (subject to their prior consent) the land to be entered into a new, Stewardship or Sustainable Farming Incentive (SFI) Scheme. The Tenants enter such schemes at their own risk.

Nitrate Vulnerable Zone
The land is situated in a Nitrate Vulnerable Zone for both groundwater and surface water. The incoming Licensee/Tenant(s) will be required to adhere to all regulations in that regard.

Wayleaves & Easements
The Landlord will retain all wayleave and easement payments as they affect the Land.

Sporting & Timber Rights
The sporting and timber rights will be included within the Farm Business Tenancy only for the tenancy term.

Outgoings
The incoming Tenant(s) will be responsible for all drainage charges and any other outgoings from the commencement of the Tenancy. There will be no charges in respect of the mowing licence.

OPTION 1 - MOWING LICENCE
A mowing licence for the period 1st July 2025 until 19th September 2025
Licence fee to be paid to Licensor on signing of the licence.
Licensee will be required to use the land solely for agricultural purposes.
During the Mowing Licence period the Licensee is permitted to mow and removing the grass from the subject land only.

OPTION 2- TENANCY AGREEMENT
The land is to be let under a five-year Farm Business Tenancy and the requisite Notices will need to be exchanged prior to the letting. The Tenancy will make provision for the following matters amongst others: -
a)The Tenancy will be granted to an individual who will be personally responsible for farming the land (either on his/her own account or as a Partner or Director of a farming business)
b)The Tenancy will commence on 29th September 2025 and expire 28th September 2030 and continue thereafter year to year until Notice is given by either party.
c)Rent will be payable half yearly in advance on the 29th September and 25th March in each year, the first payment being due on the commencement of the Tenancy
d)The rent will be capable of review in accordance with the Agricultural Tenancies Act 1995
e)No Genetically Modified crops or Maize crops are to be grown on the holding
f)The incoming Tenant is to hold suitable public liability insurance (minimum £5,000,000)
g)The Land is let on a full repairing and insuring basis. The Tenant will be required to put and keep the land in good Tenantable condition
h)The Tenant shall not be able to assign or under-let or share possession of the land or enter into any cropping licences with third parties
i)The Tenant will be required to use the land solely for agricultural purposes, specifically the growing of crops.

VAT
The Landlord reserves the right to charge VAT on the rent. The land is not currently opted for VAT.

Prospective Licensees/ Tenants may view the land at their own risk with this document in hand, having first notified the agent.

CONDITIONS OF TENDER
1.Tenders to be for a fixed sum of money and not a sum of money calculable by reference to any other tender.
2.The Licensor/ Landlord reserves the right not to accept the highest or any other tender.
3.Potential Licensee /Tenants will be advised of their success or otherwise of their tender within ten working days, subject to satisfactory references being obtained if necessary.
4.Potential Licensee / Tenant(s) will be bound by their tender as soon as their tender has been accepted and they are notified of their success.
5.The successful Licensee / Tenant(s) will be required to sign a Mowing Licence / Farm Business Tenancy Agreement to be prepared by Brown & Co. acting for the Licensor / Landlord.
6.References may be required.
